Cycle of Samsara (the brand) provides a curated, peer-to-peer marketplace for buying and selling pre-loved/pre-owned fashion. By accessing or using our platform, you agree to these Terms and Conditions. Please read them carefully.
LET'S GET STARTED WITH THE BASICS
1. About You and Us
Who We Are
Hey there! We're Cycle of Samsara, a Unit of Styleise Outfiters LLP. Cycle of Samsara (referred to as "we," "us," or "our") offers a marketplace where registered users can list, buy, and sell second-hand fashion items. We aim to facilitate a trusted and sustainable shopping experience using our professional and expert knowledge.
What We Do
We own and manage websites, applications, and other platforms (altogether, our Site) where we provide the following Services:
- Hosting:Acting as an intermediary between Buyers and Sellers. We don't buy or sell Items on the Catalogue and are not a party to any Transactions. We only connect buyers with sellers and vice versa.
- Buyer Protection: We charge a fee for every Transaction, ensuring that payments are made safely and allowing Buyers to get a refund if their Item is lost, damaged, or does not match the description. Our customer support team provides the necessary support with regard to the above.
- Optional Services: We provide additional services for Buyers and Sellers as described further in these Terms.
We are responsible for the Services we provide within the limits of applicable laws, our commitments, and under the conditions set out in the Terms and Conditions as provided herein.
About You and Our Users
To qualify to be one of our users, you are required to:
- Have attained at least 18 years of age.
- Have opened an account with us.
- Intend to use our Services for your personal use and benefit only.
- Have the capacity and rights to carry out Transactions on the Site.
- Agree to the Terms and Conditions and the rules contained herein.
Your Choice to Buy and Sell
Users can be:
- A Seller, who lists goods and items for sale (each and every Item) on the electronic Catalogue on our Site.
- A Buyer, who views, searches, and buys an Item or multiple Items as part of a bundle by clicking the buy button, provides payment details, and makes payment by clicking on the "Pay" button to complete a Transaction.
2. About These Terms
These Terms and Conditions (the Terms) are a legal agreement between you and us and govern your use of our Site and Services. You agree to these Terms by clicking the button indicating your acceptance while registering for a personal account with us (an Account) or when notified of updates to these Terms.
Other important information:We provide links to important information in these Terms, including our Help Centre, where you'll find answers to frequently asked questions (FAQ). If you can't find what you're looking for, feel free to reach out to us.
Privacy Policy: Our Privacy Policy governs the collection, use, and disclosure of your personal information. By using our services, you agree to its terms.

To raise a dispute:We hope you enjoy using our Services, but if there's a disagreement between us, please let us know through our Help page. We shall try to resolve the issue as quickly as possible.

4. Becoming Our User
a) Curated Listings: We reserve the right to accept or reject listings as ours is a curated platform. To improve your chances of selling, we may suggest changes to your listing to make it more defined.
b) Account Registration: To use our platform, you must register for an account. Each user can only have one account. You are responsible for maintaining the confidentiality of your login details. All activity conducted through your account is your sole responsibility.
Verification and Security Actions: During registration or while using our Services, we may ask you to verify your account information, provide additional details, or provide social media links to prevent spam. Failure to provide information may result in account blocking.
Account Restrictions: Users can have only one account. If we block your account for rule violations, creating a new account is not permitted.
5. Using Information You Share with Us
How we use your personal data: While we implement robust security measures, we cannot guarantee complete protection against cyber attacks. Please consider the personal data you provide as being submitted at your own risk.
How we can use your Content: You grant COS a non-exclusive, worldwide, royalty-free licence to use, copy, display, and adapt your Content for operational and advertising purposes across all media (TV, Print, Internet, Social Networks).
6. What You Must and Must Not Do
You must: Comply with these Terms, provide accurate information, keep your credentials confidential, and be responsible for the accuracy of your photos, videos, and data.
You must not: Engage in illegal activity, use bots or scraping tools, disrupt Site operations, delete and re-list items repeatedly to manipulate rankings, or advertise other websites on the Site.
7. Our Rights to Handle Concerns
If you violate these Terms, we may send warnings, remove items, demote content, or block your account. If blocked, you cannot use the Site except for Support; items will be removed, and pending transactions may be cancelled.
8. How to Set Up a Wallet (Wallet Balance)
The Wallet is an electronic wallet used to receive funds from sales, buy items, or transfer to bank accounts (Payouts). Sellers are required to create a Wallet within 5 calendar days of their first sale, or the transaction will be cancelled.
9. How to Make Payments
Payments can be made via Wallet funds, UPI, or credit/debit cards. Money paid for an item is held in a separate Escrow account until the Transaction is completed.
10. Sending Messages and Leaving Reviews
Private messages must not be used for advertising or sharing personal data.
Mandatory Reviews: Buyers must submit a review within 3 days of receipt. If not submitted, the system assigns a default 5-star review. Once submitted, reviews cannot be edited.
11. Ending Our Relationship
You can delete your account at any time. We reserve the right to terminate with 15 days' notice. These Terms remain in effect until all pending transactions are cleared.

12. Selling an Item on Our Site
Listings must include a minimum of 2 and a maximum of 10 original photos, plus 1 compulsory video. All content must be original — no images or videos taken from the internet. Descriptions must be truthful and detailed. Once approved by the admin, the listing appears in the Catalogue.
Commission: We charge a flat commission rate of 25% on all products.
Luxury Items: High-value items undergo verification. Sellers must ship items within 5 calendar days of sale.

13. Buying an Item
Buyers pay the Item price, Shipping fee, and Buyer Protection fee. We are not responsible for transactions occurring offline or outside the platform.
14. Buyer Protection
Buyer Protection provides refunds if an item is lost or damaged in shipping, significantly not as described, or counterfeit. You must report issues within 3 calendar days via the "I have an issue" button.
Returns: Accepted only for misrepresentation or authentication failure. No returns for sizing issues or change of mind.
15. Authentication & Warehousing Terms
Authentication for luxury items is provided via our dual-verification process using Authenticate First and Legit Grails, with a combined accuracy of 99.3%.
- Items priced above ₹20,000 receive complimentary authentication.
- Items priced between ₹5,000 and ₹20,000 are eligible for authentication as an add-on service.
Buyers pay the authentication fee upfront where applicable. If verification fails, the buyer receives a full refund. Sellers who submit counterfeit items face penalty fees and account suspension.
16. Shipping
Sellers must ship within 5 calendar days of sale.
Prepaid Shipping (COS Label): Buyers are fully refunded if items are lost or damaged during transit.
Non-Prepaid Shipping (Seller-Arranged): The seller bears full responsibility for loss, delay, or damage. COS will not provide a refund, protection, or courier support.
17. Payments and Payouts
Funds are released to the Seller after buyer confirmation or 3 days post-delivery. Withdrawals to bank accounts take 3–4 working days.
18. Disputes and Resolutions
We mediate all disputes. Our final decision is binding on both parties.
19. Prohibited Activities
- Listing counterfeit or stolen goods.
- Fraudulent transactions or money laundering.
- Violating intellectual property rights.

20. Site Ownership & Availability
Cycle of Samsara owns all intellectual property on the Site. We strive to minimise downtime but are not responsible for interruptions due to maintenance or force majeure.
21. Cancellation Policy
Buyers: May cancel before the item is shipped.
Sellers: Cannot cancel once an order is placed unless the item is damaged.
22. Inactive Accounts
Accounts inactive for 24 months may be deactivated. Unclaimed wallet balances may expire after 12 months with prior notice.
23. Governing Law
These Terms are governed by the laws of India. Any disputes will be resolved under the exclusive jurisdiction of the courts at Kolkata.
