Terms and Conditions

These Terms and Conditions (the "Terms") are a legal agreement between you and Cycle of Samsara and govern your use of our Site and Services. You agree to these Terms by clicking the button indicating your acceptance when registering for an account (an "Account") or when notified of updates to these Terms.

Other policies: These Terms should be read together with our Privacy Policy, Refund & Dispute Policy, Shipping Policy and User Guidelines. Our Privacy Policy explains how we collect, use and protect your personal information.

To raise an issue with an order: Use the "I have an issue" button on your order, or our Help page. We will try to resolve the issue as quickly as possible.

a) Curated listings: Cycle of Samsara is a curated platform. We may accept or reject any listing and may suggest changes to improve your listing.

b) Account registration: You must register for an Account to use the Site. You are responsible for keeping your login details confidential, and all activity on your Account is your responsibility.

c) One account per user: Each user may have only one Account. If we block your Account for breaking these Terms, you may not create a new one.

d) Verification and security: During registration or while using our Services, we may ask you to verify your identity or account details, provide additional information, or share social media links to prevent spam and fraud. If you do not provide the requested information, we may restrict or block your Account.

Your personal data: We collect, use and protect your personal data as described in our Privacy Policy, and we take reasonable security measures to keep it safe.

Your content: You grant Cycle of Samsara a non-exclusive, worldwide, royalty-free licence to use, copy, display and adapt the photos, videos and descriptions you upload (your "Content") for operating the Site and for advertising across all media, including TV, print, the internet and social networks. You confirm you own your Content or have the right to share it.

You must: comply with these Terms, provide accurate information, keep your login details confidential, and be responsible for the accuracy of your photos, videos and data.

You must not: engage in illegal activity, use bots or scraping tools, disrupt the Site, delete and re-list Items repeatedly to manipulate rankings, or advertise other websites or sell outside the Site.

If you break these Terms, we may send warnings, remove Items, reduce the visibility of your listings, or restrict or block your Account. If your Account is blocked, you can only contact Support; your Items will be removed and pending Transactions may be cancelled.

Seller payouts are made directly from escrow to the bank account you provide ("Payouts"). Sellers must add their payout bank details within 5 calendar days of their first sale, or the Transaction may be cancelled. Cycle of Samsara does not currently offer a wallet or stored balance.

Payments can be made using UPI, credit or debit cards, net banking, or other methods shown at checkout. Some payment methods have transaction limits set by banks or payment providers (for example, UPI limits on high-value orders). Money paid for an Item is held in escrow with our payment partner until the Transaction is completed.

For selected Items, Cycle of Samsara may allow a Buyer to reserve an Item by paying a token amount, with the balance paid later.

• The token amount is held by Cycle of Samsara in escrow and is not paid to the Seller until the full price is received.
• The Item is reserved for the Buyer for the period agreed at the time of payment. During this period it will not be sold to anyone else.
• The invoice is issued once the full amount has been received.
• If the Buyer does not pay the balance within the reservation period, or cancels the reservation, the token amount is non-refundable and the Item is released for sale.
• If the Seller cancels, the Item is no longer available, or the Item fails authentication or is not as described, the Buyer receives a full refund of the token amount.

Messages: Private messages must not be used for advertising, for arranging sales outside the Site, or for sharing personal contact details.

Reviews: After your order is delivered, we will invite you to review the Seller. Reviews are optional. You can edit your review within 7 days of posting it. We never create or change reviews on a user's behalf. We may remove reviews that are abusive, fake or unrelated to the Transaction.

Service messages: We will send you messages about your Account, orders, payments, shipping and disputes by email, SMS and WhatsApp. These are part of the Service and cannot be switched off while you have active Transactions.

Marketing messages: We will send you offers, new arrivals and other promotional messages only if you opt in, using a separate checkbox that is never pre-ticked. You can opt out at any time by replying STOP on WhatsApp, using the unsubscribe link in any email, or writing to customercare@cycleofsamsara.com.

You can delete your Account at any time. We may close your Account with 15 days' notice, or immediately if you break these Terms. These Terms continue to apply until all pending Transactions and Payouts are completed.

Listings: Each listing must include at least 2 and at most 10 original photos, plus 1 compulsory video. All content must be your own; images or videos taken from the internet are not allowed. Descriptions must be truthful and detailed and must disclose all defects, alterations and signs of wear. Once approved by our team, your listing appears in the Catalogue.

Minimum price: New listings must be priced at ₹5,000 or above. Items listed below ₹5,000 before this rule took effect may remain on sale.

Commission: Cycle of Samsara charges Sellers a flat commission of 25% of the Item price. No GST or other charge is added to this commission. Shipping fees, the Buyer Protection fee and any authentication fee are not part of the Item price. The Seller receives 75% of the Item price, less any tax deducted as required by law.

High-value Items: Items priced at ₹20,000 or above must be authenticated before delivery (see Section 18).

Dispatch: Sellers must ship Items within 5 calendar days of sale.

By listing an Item, you confirm that:

• you own the Item and have the full right to sell it;
• the Item is genuine and is not counterfeit, a replica, stolen or obtained unlawfully;
• the Item is free of any claim, lien or dispute by another person;
• your listing, photos and video accurately show the Item and disclose all defects, alterations and signs of wear; and
• selling the Item does not infringe anyone's intellectual property or break any law.

If any of these statements turns out to be untrue, Cycle of Samsara may cancel the sale, refund the Buyer, withhold your Payout for that Item (or recover it if already paid) and suspend your Account.

You agree to indemnify and hold harmless Cycle of Samsara, Styleise Outfiters LLP, its partners, employees and service providers against any claims, losses, penalties, costs and legal fees arising from:

• an Item you listed being counterfeit, stolen, misdescribed or unlawful to sell;
• any claim by a brand owner or other third party that your Item or listing infringes their intellectual property; or
• your breach of these Terms or of any law.

Buyers pay the Item price, the shipping fee, the Buyer Protection fee and, where chosen or applicable, an authentication fee. All charges are shown before you pay. We are not responsible for any transaction arranged or paid for outside the Site.

Buyer Protection gives you a refund if your Item is lost or damaged in transit, significantly not as described, or counterfeit.

Returns: We accept returns only where an Item is not as described, damaged, counterfeit, or fails authentication. We do not accept returns for sizing, fit or change of mind, and we do not offer exchanges.

Authentication disclaimer: Authentication is an expert opinion provided by our independent third-party authentication partners, based on their inspection of the Item at the time it is checked. It is not a guarantee from the brand. If an Item authenticated through Cycle of Samsara is later shown to be counterfeit, the Buyer's remedy is a full refund of the amount paid on return of the Item.

Sellers must ship within 5 calendar days of sale. If an Item is not shipped in time, the order is cancelled and the Buyer is refunded in full.

Prepaid shipping (Cycle of Samsara label): If an Item is lost or damaged in transit, the Buyer is refunded in full under Buyer Protection.

Seller-arranged shipping: Where a Seller uses their own courier, the Seller bears full responsibility for loss, delay or damage, and Cycle of Samsara will not provide courier support for that shipment.

The Seller's share (75% of the Item price, less any tax deducted as required by law) is paid from escrow to their bank account once the Buyer's claim window has closed with no open dispute, and usually reaches the account within 3–4 working days.

If a Buyer and Seller disagree, Cycle of Samsara will review the evidence from both sides and decide in good faith how the funds held in escrow are released. This process does not limit your rights under the Consumer Protection Act, 2019 or any other applicable law.

Prohibited activities. You must not carry out fraudulent Transactions or money laundering, or infringe anyone's intellectual property.

Cycle of Samsara may remove any listing it considers prohibited, without notice.

Our intellectual property: Cycle of Samsara owns all intellectual property in the Site, apart from Content uploaded by users.

Brand non-affiliation: Brand names, logos and trademarks shown on Cycle of Samsara belong to their respective owners and are used only to identify and describe pre-loved Items. Cycle of Samsara is an independent resale marketplace and is not affiliated with, authorised by, endorsed by or sponsored by any brand whose Items appear on the platform.

Availability: We aim to keep downtime to a minimum but are not responsible for interruptions caused by maintenance or events beyond our control.

Buyers: You may cancel an order before the Item is shipped and receive a full refund.

Sellers: You may not cancel once an order is placed unless the Item has been damaged. If you do not ship within 5 calendar days, the order is cancelled automatically and the Buyer is refunded. Repeated cancellations may lead to restrictions on your Account.

Accounts inactive for 24 months may be deactivated. Any Payouts still owed to you will be paid to your bank account before your Account is deactivated.

Entire agreement. These Terms, together with our Privacy Policy, Refund & Dispute Policy, Shipping Policy and User Guidelines, form the entire agreement between you and Cycle of Samsara about your use of the Site.

Precedence. If these Terms conflict with another policy, the policy that deals specifically with the subject applies (for example, the Refund & Dispute Policy for refunds, and the Shipping Policy for shipping). Otherwise, these Terms prevail.

Severability. If any part of these Terms is found invalid or unenforceable, the rest remains in full effect.

No waiver. If we do not enforce a right under these Terms, we have not given up that right.

Assignment. You may not transfer your Account or your rights under these Terms. Cycle of Samsara may transfer its rights and obligations to an affiliate or to a successor of its business.

Notices. We will send notices to the email address or phone number registered on your Account. You can send notices to us at customercare@cycleofsamsara.com or Room No. 3D, 3rd Floor, 161 Chittaranjan Avenue, Kolkata 700007.

Force majeure. Cycle of Samsara is not responsible for any delay or failure caused by events beyond its reasonable control, including natural disasters, floods, epidemics, strikes, government action, war, internet or power failures, or disruption at courier or payment partners. Affected orders will be completed once the event ends, or cancelled and refunded where that is not possible.

Relationship. Sellers are independent users. Nothing in these Terms makes a Seller an employee, agent or partner of Cycle of Samsara.

Survival. Clauses on payments owed, indemnity, intellectual property, disputes and governing law continue after your Account is closed.

These Terms are governed by the laws of India. Subject to your rights as a consumer to approach a Consumer Commission under the Consumer Protection Act, 2019, the courts at Kolkata have exclusive jurisdiction over any disputes.
